BBA Property Advocates (ABN 32 672 926 957) is committed to protecting your privacy and complying with the Privacy Act 1988 (Cth) (the Act), including the Australian Privacy Principles (APPs).
This Privacy Policy explains how we collect, hold, use and disclose personal information in connection with our buyer’s agency services and this website. It also serves as our privacy collection notice under APP 5.
We may update, revise or replace this Privacy Policy from time to time by posting the updated version on this website. The date at the top shows when it was last updated.
What personal information do we collect?
Depending on your relationship with us, we may collect:
- your name, address, phone number, email address and profession or occupation;
- your property search criteria, budget, financing status and purchasing preferences;
- identification documents (such as driver’s licence or passport) collected as part of our client onboarding and verification process;
- financial information reasonably necessary to assist with your property search and purchase (e.g. pre-approval details, when voluntarily provided);
- correspondence and records of your instructions to us; and
- any other personal information you provide when you contact us, make an enquiry, or engage our services.
If information personally identifies you, or you are reasonably identifiable from it, it is “personal information” for the purposes of the Act.
How we collect personal information
We collect personal information:
- directly from you, when you contact us via our website, phone, email, or in person (e.g. at a Discovery Call or property inspection);
- when you engage us as your buyer’s agent, including identification documents collected for client verification and compliance purposes;
- from third parties, where reasonably necessary, for example, selling agents, conveyancers/solicitors, mortgage brokers, or other advisors involved in a property transaction you’ve engaged us on; and
- from publicly available sources, such as property listing platforms and public property records.
Why we collect, use and disclose your information
We collect and use your personal information to:
- identify you and verify your identity as our client;
- search for, assess and negotiate on properties on your behalf;
- communicate with you about your property search, inspections, offers and settlement;
- liaise with selling agents, conveyancers, mortgage brokers and other parties involved in a transaction you’ve instructed us on;
- comply with our legal obligations, including under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (see below); and
- with your consent (and unless you tell us otherwise), send you market updates or information about our services (direct marketing).
We do not sell your personal information to third parties.
AML/CTF obligations
As a real estate professional, we are subject to obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) from 1 July 2026. This requires us to collect and verify identification information from clients as part of our client onboarding process. We only collect the personal information reasonably necessary to meet these obligations, in line with APP 3.2.
Automated Decision Making
We do not currently use automated decision-making (ADM) — that is, computer programs that make, or materially assist in making, decisions that could significantly affect your rights or interests — in the operation of our business. If this changes, we will update this Privacy Policy to describe the personal information used and the kinds of decisions involved.
Cookies and website analytics
Our website uses cookies and similar tracking technology (including Google Analytics and the LinkedIn Insight Tag) to understand how visitors use the site and to improve our services. You can manage or disable cookies through your browser settings, though this may affect some website functionality.
Direct marketing
We may use your personal information to keep you informed about our services and relevant market updates, unless you tell us not to. You can opt out at any time by contacting our Privacy Officer (details below).
Information security
We take reasonable steps to protect the personal information we hold from misuse, loss, unauthorised access, modification or disclosure. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security of information transmitted to us online.
